Entity operating the website www.sheissunday.com, and on it the She is Sunday online store (hereinafter referred to as “Store”) is She is Sunday Sp. z o.o conducting business activity, ul. Dynasy 4, 00-354 Warsaw, REGON  384749275, NIP 5252805645, registered in the Central Register and Information on Economic Activity (hereinafter referred to as “SIS” or “we”).

Why do we ask you to read our Terms and Conditions? 

These Terms and Conditions set out the rules and conditions for (i) using our website www.sheissunday.com, where you can shop in the Store and create your customer account (“Account”) and (ii) making purchases in our stationary boutique (hereinafter referred to as “Boutique”).

Here you will also find the rights and obligations of SIS as the seller and yours as the customer (hereinafter referred to as “Customer” or “You”) and our commitments to you as a consumer (hereinafter referred to as “Consumer”), which apply to Customers who are natural persons making purchases not directly related to their business or professional activity.

We strongly encourage you to carefully read these Terms and Conditions and the Privacy Policy before starting to use our website. 

What are your obligations when using our Store?  

Our Store provides electronic services at the website www.sheissunday.com, through which the Customer enters into a distance sales agreement with SIS. The Customer will receive this agreement at the email address provided when placing the order. 

The Customer may use the Store provided they are at least 18 years old and have full legal capacity.

When using the Store, i.e., placing orders or creating an Account, the Customer agrees to provide their personal data and necessary information marked with an asterisk, without which SIS will not be able to fulfill the order or create an Account. All information about how SIS processes your personal data can be found by the Customer in the Privacy Policy.

How to order our products? 

Our products offered in the Store are new, and their detailed description can be found on the Store page (including: price, description, material composition, recommended care, and sizes) so that the Customer can make an appropriate product choice.  

Before placing an order, the Customer must accept the Terms and Conditions, which become binding for each order placed. Later changes to the Terms and Conditions will not apply to the Terms and Conditions accepted for each order.  

An order can be placed on the Store website by (i) adding the selected product to the cart, (ii) proceeding to payment, (iii) registering on your Account or as a guest, and (iv) clicking the button confirming permission to pay.

The Customer must choose the product delivery method to the given address, the payment method, and the billing address (including invoice details if applicable).

Orders in the Store can be placed 24 hours a day, 7 days a week. Orders placed on Saturdays, Sundays, or holidays are processed the next business day.

By clicking the "Order and pay" button, the Customer confirms placing the order. Immediately after placing it, SIS sends the Customer an email to the email address provided when placing the order, confirming the order and containing the Customer's order number, which constitutes a sales contract between SIS and the Customer. The sales contract is concluded at the moment the above email with the assigned order number is sent to the Customer.

An order that has not been confirmed or paid for by the Customer is considered canceled, and SIS will not proceed with its fulfillment. 

SIS may contact you at the email address provided when placing the order to resolve any obstacles you encountered while placing the order. 

The standard shipping time within Poland is from two (2) business days up to a maximum of fourteen (14) business days, especially during sales or special SIS promotions.

How do we deliver your ordered products? 

We offer the following delivery methods for your ordered product:

  • InPost Parcel Locker, InPost Courier to the address provided by the Customer when placing the order.

Shipping costs depend on the delivery location. The shipping price will be calculated individually based on the provided delivery address, and all related fees will be presented in the final price summary before payment. 

The product is delivered via a courier company or postal operator according to the Customer's choice. SIS informs the Customer by email when the product is taken over by the courier. Then, the delivery date will be indicated by the courier.  

Within Poland, the product will be delivered within a maximum of two (2) weeks from placing a correct order.

An order that is not collected from the courier will be canceled, and the funds will be refunded to the customer minus the costs related to sending the product.

What is the pricing and payment policy at She is Sunday? 

In our Boutique, the prices displayed on products are gross prices in Polish zloty (prices include VAT).

The same principle is applied in our Online Store, where the prices visible on each product page are gross prices in Polish zloty (prices include VAT). The product price does not include delivery costs.

Delivery costs (e.g., transport, delivery, postal services) are borne by the Customer and are added to the final price at the time of choosing the delivery method and entering the delivery address by the Customer when placing the order. 

The price given at the time the Customer places the order is binding for both parties.

After placing an Order, the Customer should make payment via the Przelewy24 or PayPal system. The Order is processed after the Customer's payment is credited in the Przelewy24 and PayPal payment systems.

Why is it worth creating your Customer Account in our Store?  

To facilitate the use of our website, the Customer may choose to create a Customer Account.  

To create an Account, the Customer must fill out the registration form available on the Store's website. This form contains fields where the Customer must provide their data, including first name, last name, email address, and access password. The Customer agrees to provide true and current information during registration. Then, the Customer will receive an email with a link to verify the Account. Logging into the Account involves entering the login and password set by the Customer.

The customer is responsible for keeping their password and access data to the Customer Account confidential. In case of loss or unauthorized access to the Account, the Customer is obliged to immediately inform SIS. The password is confidential and should not be shared with anyone.

Creating a Customer Account on our website brings many benefits to the Customer, including:  

  • Easier access to purchase history and order tracking, 
  • Ability to save and manage favorite products,
  • Receiving personalized product recommendations,
  • Faster shopping thanks to saved delivery data.  

The customer may cancel their Store Account at any time by sending an appropriate request to SIS electronically at the email address: ciao@sheissunday.com or in writing to the Seller's address: ul. Dynasy 4, 00-354 Warsaw.

What is our return policy in the Store? 

You have the right to withdraw from the purchase agreement and return the product within fourteen (14) days of receiving the shipment. The return policy applies only to purchases made in the Online Store. Products purchased in the Boutique are not subject to this return policy. 

Products must be returned in their original condition with all attached tags. We do not accept clothing showing signs of use. 

ATTENTION! Please include the form in the return package - it can be handwritten or you can use our return form - containing the following information:

  • Information that the shipment is a product return,
  • order number,
  • product name,
  • size of the returned product.

We do not accept returns without the above information included

She is Sunday does not cover the cost of shipping the product return to SIS. We do not accept packages sent to the InPost locker – the return must be delivered directly to the address above. 

  • use our InPost Quick Returns service. 

Using this service costs twenty (20) PLN within Poland. This amount will be deducted from the order.

How to use the quick returns service?

Go to the website www.szybkiezwroty.pl, select our store from the list and fill out the form. 

You will receive an SMS with a code for the InPost locker at the phone number you provided, valid for 72 hours (if you have the app, the code will be visible in the app). 

Prepare the return package – pack and secure the shipment. If you use the same box (we encourage being eco and zero waste!), remove the old label. You do not need to print any new label – when sending, use the generated return code, which you write on the return package. 

Go to any InPost 24/7 locker. On the screen, select: "Send a package," then "I have a shipment or return code." Enter the code from the previously received SMS.
Place the package in the locker, close the door, and that's it! You will receive a confirmation of shipment by SMS. You can track the shipment on the InPost website.

 

According to the law, the consumer is responsible for the reduction in the value of the goods if they have used it beyond what is necessary to establish its nature, features, and functioning (Legal basis: Article 34 section 4 of the Consumer Rights Act). Products must be returned in their original condition with all attached tags. We do not accept clothing showing signs of use.

After receiving the returned product, within the next 14 business days, SIS will send the customer a decision to reject the return. This decision will include an explanation of the situation, e.g., missing paper tag or signs of product use.

Rejected returns must be collected from She is Sunday at your own expense.

The right to withdraw from the contract does not apply to the Consumer if the product is made according to the Consumer's specifications or serves to satisfy their personalized needs.

Return Policy in Physical Boutiques

Returns in She is Sunday physical boutiques are subject to separate rules. From 2.01 onwards, it is not possible to return a product in boutiques for cash or the original payment method.
A product purchased in-store can be:

  • exchange for another size of the same model, if available,
  • exchange for another product of the same or higher value (with possible additional payment),
  • refund to a gift card for use in the boutique.

Products eligible for exchange or return must be in an intact condition, without signs of use, and with all tags attached.

When does the Client have the right to exchange a product? 

Clients have the right to exchange a product purchased in the Boutique within fourteen (14) days from the date of purchase. Only exchanges within the same model are possible (this applies to exchanging size and/or color). 

Products purchased in our online Store are not eligible for exchange.

How to file a complaint?  

If the Client notices that the product does not match the order or is damaged, the Client should immediately (preferably within 7 days from the date of receipt of the shipment) file a complaint with SIS by email at help@sheissunday.com .

The complaint email must include:  

  • title: "Complaint",
  • a detailed description of the problem and, if possible, photographic documentation.

SIS undertakes to consider the Client's complaint within fourteen (14) business days. 

If the complaint is accepted, SIS will contact the Client by email with a proposal to repair the product or replace it with a new one.  

After consulting with the Client, SIS will take appropriate actions to collect the defective product and send back the repaired or new product at SIS's expense. 

If repair or replacement is not possible, the Client may choose a voucher equivalent to the product value, valid for 1 month from its issuance. Alternatively, the Client has the right to withdraw from the contract and cancel the order. SIS will refund the amount paid for the claimed product and the shipping cost incurred by the Client up to the amount corresponding to the cheapest shipping option available in the SIS offer.

In case of a rejected complaint, the Client will receive an email notification explaining the reason for the rejection.

 SIS Intellectual Property 

The rights to the website and its content belong to SIS.

The website address where the Store is available, as well as the content of the website www.sheissuday.com, are subject to copyright and protected by copyright and intellectual property law.

All logos, proper names, graphic designs, videos, texts, forms, scripts, source codes, slogans, trademarks, service marks, etc. are registered trademarks and belong to SIS. Downloading, copying, modifying, reproducing, transmitting, or distributing any content from the website www.sheissunday.com without the owner's consent is prohibited.

What is the procedure in case of a dispute with the Client? 

Any disputes between the Organizer and the Client (Consumer) will primarily be resolved through negotiations, with the intention of an amicable settlement. However, if this is not possible or satisfactory for either party, disputes will be resolved by the competent common court in accordance with the provisions of the Code of Civil Procedure of November 17, 1964.
