LOYALTY PROGRAM TERMS AND CONDITIONS “Sunday Club”
§ 1
GENERAL PROVISIONS

These Terms and Conditions define the rules of the "Sunday Club" Loyalty Program operating within the www.sheissunday.com online Store

The Organizer of the Loyalty Program is "Sunday Points" (hereinafter: "Program"), organized by SHE IS SUNDAY SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ with its registered office in Warsaw, at ul. Dynasy 4, 00-354 Warsaw, email address: ciao@sheissunday.com.

The Loyalty Program is intended for Clients of the www.sheissunday.com Store

Each Client holding an Account in the Store may participate in the Loyalty Program.

Each Client, upon undertaking actions aimed at using the Loyalty Program, is obliged to comply with the provisions of these Terms and Conditions and the terms and conditions of the www.sheissunday.com online Store

A condition for joining and participating in the Loyalty Program is having an Account in the Store and familiarizing oneself with and accepting these Terms and Conditions.

In matters not regulated by these Terms and Conditions, the provisions of the online Store's terms and conditions operating at the address www.sheissunday.com, the provisions of the Civil Code, and other applicable Polish law regulations.
§ 2
DEFINITIONS

LOYALTY PROGRAM – the loyalty program of the www.sheissunday.com Store organized by the Organizer.

TERMS AND CONDITIONS – these terms and conditions of the Loyalty Program.

STORE – the Organizer's online store operating at the address www.sheissunday.com

ORGANIZER – The Organizer of the Loyalty Program is "Sunday Points" (hereinafter: "Program"), organized by SHE IS SUNDAY SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ with its registered office at ul. Dynasy 4, 00-354 Warsaw

CLIENT – Client of the www.sheissunday.com Store, holding an active Account.

CONSUMER – a natural person who performs a legal act with an entrepreneur not directly related to their business or professional activity.

ACCOUNT – marked with an individual name (login) and password, a set of resources in the Organizer's IT system, where Client data is collected, including information about orders placed by them.
§ 3
PARTICIPATION RULES AND
POINTS IN THE LOYALTY PROGRAM

To join the Loyalty Program, a Client interested in participation should perform the following actions:

familiarize yourself with the basic information about the Loyalty Program available on the Store's website,

register an Account in the Store www.sheissunday.com via the registration form, in accordance with the Store regulations,
-
read and accept these Terms and Conditions.

Through the Loyalty Program, the Organizer enables Clients to accumulate points for products purchased in the Store.

Points can be exchanged for discounts, which the Client can use when placing subsequent orders in the Store.The exchange rate of points is: 100 Sunday Coins = 1 zł discount.

The Client, after enrolling in the Loyalty Program, receives points for every sales contract concluded with the Organizer through the Store. Points are awarded to the Client from the moment of joining the Loyalty Program and placing and paying for the first order in the Store.

The Organizer will grant a registered Client 1 point for every zloty spent in the Store.

Points are credited to the Client's Account at the moment the payment for the order is recorded in the Organizer's bank account.

SundayCoins received for a specific order are valid for 12 months from the date they are credited to the Client's Account. After this period, the points expire and cannot be used in any way.

Subject to point 7 of this paragraph, points earned by the Client, entitling them to receive a discount, accumulate.

The Client can check the current number of points after logging into the Client Account on the Store's website.

Points are non-transferable.

The Organizer has the right to withdraw points previously credited to the Client:
-
11.1. in the event of the Client terminating the sales contract concluded with the Organizer as a result of exercising the consumer's right of withdrawal. In this situation, the Organizer deducts from the Client's Account the number of points corresponding to the value of the returned products,
-
11.2. in the event that the Client received points undeservedly.

The Organizer is not responsible to Clients who are not Consumers for the loss of points due to technical issues.
§ 4
DURATION OF THE LOYALTY PROGRAM

The Loyalty Program is introduced for an indefinite period from the day December 17, 2024.
-
The Organizer reserves the right to suspend or terminate the Loyalty Program.

Information about the suspension or termination of the Loyalty Program will be posted on the Store's website at least 3 months in advance.

In case of termination of the Loyalty Program, unused points become invalid and cannot be used in any other way.
§ 5
TERMS OF TERMINATION OF PARTICIPATION IN THE LOYALTY PROGRAM

The Client may at any time, without giving any reason, withdraw from participation in the Loyalty Program by sending an appropriate statement to the Organizer via e-mail to: ciao@sheissunday.com or by selecting the appropriate option in the Account settings in the Store.

In case of withdrawal from the Program, the Client loses all previously acquired points.
§ 6
COMPLAINT PROCEDURE

Complaints related to the Loyalty Program may be submitted via e-mail to: ciao@sheissunday.com.

In the above e-mail message, please provide as much information and circumstances regarding the subject of the complaint as possible, in particular the type and date of the irregularity and contact details. The provided information will significantly facilitate and speed up the consideration of the complaint by the Service Provider.

The Service Provider considers the complaint immediately, no later than within 14 days from the date of submission.

The Service Provider's response to a complaint is sent to the Client's e-mail address provided in the complaint or by another method indicated by the Service Provider.
§ 7
PERSONAL DATA

The administrator of personal data collected in connection with the implementation of the provisions of these Terms and Conditions is "Sunday Points" (hereinafter: the "Program"), organized by SHE IS SUNDAY SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ with its registered office at ul. Dynasy 4, 00-354 Warsaw.

The Administrator processes Clients' personal data for the purpose of implementing the Loyalty Program, based on Article 6(1)(b) of the GDPR (performance of a contract for the provision of electronic services in accordance with the Terms and Conditions).

Clients' personal data are stored by the Organizer as long as necessary to perform the contract and implement the Loyalty Program, and after that period for the duration corresponding to the limitation period of claims.

Providing personal data by the Client is voluntary.

The Administrator takes special care to protect the interests of the data subjects, and in particular ensures that the data collected are:

processed lawfully,
-
collected for specified, lawful purposes and not further processed in a way incompatible with those purposes,
-
factually correct and adequate in relation to the purposes for which they are processed and stored in a form that allows identification of the persons concerned, no longer than necessary to achieve the processing purpose.

Client personal data may be disclosed to third parties only based on legal provisions or appropriate contractual relationships. Recipients of data may include, among others: accounting offices, entities handling external IT systems, entities providing legal services, authorized state authorities.

The Organizer processes Client data exclusively within the European Economic Area.

The User has the right to:

Access to data – Article 15 GDPR,

Data rectification – Article 16 GDPR,
-
Data deletion (the so-called right to be forgotten) – Article 17 GDPR,
-
Restriction of processing – Article 18 GDPR,
-
Data portability – Article 20 GDPR,
-
Objection – Article 21 GDPR,
-
Withdrawal of consent – Article 7(3) GDPR (noting that withdrawal of consent does not make the processing before withdrawal unlawful).

To exercise the rights referred to in point 8, a relevant request should be sent to the email address ciao@sheissunday.com.

If it is found that the processing of personal data violates the GDPR provisions, the data subject has the right to file a complaint with the President of the Personal Data Protection Office.
§ 8
FINAL PROVISIONS

Changes made to the Terms and Conditions by the Organizer shall be binding on the Client, provided that the Client has been properly informed of the changes and has not terminated the electronic services agreement within 14 days from the date of notification of the changes.

In the event of any part of the Terms and Conditions being inconsistent with applicable law, the relevant provisions of Polish law shall apply instead of the contested provision.

Any disputes between the Organizer and the Client (Consumer) shall first be resolved through negotiations, with the intention of an amicable settlement. However, if this is not possible or satisfactory for either party, disputes shall be resolved by the competent common court in accordance with the provisions of the Code of Civil Procedure of November 17, 1964.

For Clients who are not Consumers, disputes arising from the application of these Terms and Conditions shall be resolved by the common court competent for the Organizer's registered office.
